Any reference in these conditions shall be referenced to Liversidge Windows & Double Glazing LTD, or any
associated or subsidiary or its successor in title.
All orders are subject to the following conditions.
1.RETENTION OF TITLE
Until payment has been made for all sums outstanding from the Buyer to the Company (including debts arising
before the date of this contract)
(a)The property in the goods shall remain in the Company.
(b) The Company may repossess the goods at any time and the Buyer hereby grants to the Company an
irrevocable licence to enter upon any premises of the Buyer for the purpose of so doing.
2.RETURNS
Goods must be returned for credit without prior agreement. Drivers have strict instructions not to accept
return of goods without written authority. Goods returned surplus to requirements must be in a re-saleable
condition and will be credited at purchase price minus any cost incurred by the Company to manufacture the
product. Damaged items not subject to a claim will only be scrap value.
3.DELIVERY TO SITE
“Delivered to site” is held to mean delivery to the nearest access point to the Buyers premises in the opinion of
the Companies driver.Unloading from the vehicle must be effected by the Buyers own labour force and lifting
tackle.
4.MINIMUM DELIVERY
The minimum order value that will be delivered to a buyer will be £200 (within our normal distribution area).
Amounts less than this figure (or outside our normal distribution area) will be charged for delivery.
5.BREAKAGES, SHORTAGES AND NON-DELIVERY
The Company can accept no liability for damage or shortage when goods are delivered by our own transport
unless notice is given by phone within 48 hours and in writing to the Company within 7 days of receipt. Nondelivery must be reported to the Company within 10 days of receipt of invoice or advice of despatch. Where the
goods are collected by the Buyer, or third party nominated by the Buyer, the risk in the goods passes to the
Buyer upon delivery to the Buyer, or such third party as the case may be and thereupon all liability to the
Company in the goods for ,loss or destruction, breakages, shortages or non-delivery shall cease.
6.DEFECTEVE GOODS
Breakages, damage, shortage or unsatisfactory goods must be reported by phone within 48 hours and in writing
to the Company within 7 days.
7.CONSUMER RIGHT ACT
Any conditions and warranties implied by virtu of the Consumer Rights Act 2015
8.. LATE DELIVERY
Delivery dates are given in good faith and every effort will be made to endure due to performance, but we
cannot accept responsibility for damages or consequential loss arising from delays caused by strikes, lockouts,
breakdowns, fires or any other circumstances beyond our control. If the Buyers instructions or lack on
instructions cause delay in delivery the Company shall be entitled to extension of the time originally agreed.
9.EXPRESS TERMS
Any express term condition warranty or representation made by the Company shall be excluded from this order
unless it is made in writing by its lawful authorised agent by and on behalf of the Company.
10.PRICE
All prices quoted are fully discounted including any settlement discount that may be applicable and are without
commitment and subject to alterations or withdrawals by us without notice prior to acceptance of the order
and orders can only be accepted on condition that the prices charged are those ruling at the date of despatch
unless we have specifically engaged in a fixed term contract.
11.WARRANTY
All items are covered as follows, UPVC products – 10 Years.Double Glazed Units – 5 Years.Silicone and Sealants –
2 Years.All fittings, handles, locks and hinges etc – 1 Year.
